Examples include adult entertainment websites or platform providers, producers of adult videos, magazines and books, adult entertainment networks, escort agencies, and brothels.

Alternative Money Remittance Systems/Informal Value Transfer Systems (e.g. Hawala, Hundi, Chitti, Fei Ch'ien, Poey Kuan)

Alternative Money Remittance System/Informal Value Transfer System Any system, mechanism, or network of people that receives money for the purpose of making the funds or an equivalent value payable to a third party in another geographic location, whether or not in the same form. The transfers generally take place outside of the conventional banking system through non-bank financial institutions or other business entities whose primary business activity may not be the transmission of money.

Arms Manufacturer, Dealer or Intermediary

Any business whose primary activity is to manufacture, buy, sell, or act as an intermediary for dealing in Arms. While Arms primarily means firearms, including rifles, shotguns, handguns or anything that can be adapted to be used as a firearm, it also includes other military related weaponry including explosives, missiles, or missile related systems.

Auction Houses

Any entity whose primary business is to facilitate the sale and transfer of goods between the ultimate buyer and seller in auction transactions. This includes any alternative forms of auction through phone or online services.

Cannabis Industry (Federal/provincial/International)

An entity who is a Canadian Federal License Holder/Applicant (e.g. Cultivator/Processor/Analytical Tester/ Researcher/Medical Seller), Provincial License Holder/Applicant (e.g. Retailer, Distributor), and entities with direct or indirect connections to International Cannabis (e.g. cultivation, processing, distribution and / or sales of Cannabis or Cannabis related products). This includes Parent/Holding Company/Subsidiaries of all cannabis entity types.

Casino, Sports Betting Operator or conduct other types of Licensed Gambling

Casinos are businesses that are authorized/licensed to conduct table games (e.g. roulette or card games) in their establishment, or have slot machines or similar electronic gaming devices on their premises, where providing gambling services is their primary business.

Sports Betting Operators are businesses that are authorized/licensed to conduct sports betting and/or accept wagers. This also includes animal sporting facilities (e.g. Horse racing tracks) that accept wagers on these sporting events. .

Entities conducting other types of licensed gambling related activities as their primary business or generate at least $1 Million in gross annual revenue (i. e. those not licensed as a casino, sports betting operator or online gambling service provider) such as Bingo Halls, Raffles, Lotteries and establishments with Video Lottery Terminals.

Any businesses whose primary business activity includes cashing cheques payable to named individuals or entities and/or providing unsecured loans to individuals and/or entities on a short-term basis.

Credit Unions, Cooperative Credit Societies and Financial Service Cooperatives

Credit unions, cooperative credit societies and financial services cooperatives, are member-owned, non-profit, institutions that provide services related to financial and monetary transactions such as deposits, loans, investments, and currency exchange. These institutions perform similar activities as Financial Institutions but only provide services to their members.

Crowdfunding Service Providers

Any entities that provide and maintain online platforms which are used by other persons or entities to raise funds or virtual currency for themselves or entities specified by them. The main forms of crowdfunding are:

Rewards-based crowdfunding: Investors can donate to a project or business with expectations of receiving a non-financial reward, such as a unique service or product.

Donation-based crowdfunding: Individuals or entities donate to meet the larger funding aim of a specific project or cause.

Dealers of High Value Goods (Art/Antiquities/Vintage Alcohol)

Any entity whose primary business is to facilitate the physical sale and transfer of high value (a single good/ item sale of CAD/USD $100,000 or equivalent and above) art, antiquities (including cultural, archeological, historical and religious artifacts) or vintage alcohol between the ultimate buyer and seller. They include galleries, dealers and intermediary advisors (who may purchase the high value goods on behalf of the ultimate buyer).

Financial Institutions

Are businesses that provide services related to financial and monetary transactions such as deposits, loans, investments, and currency exchange. Financial institutions include banks, bank branches, deposit taking institutions, central banks, supranational and multilateral development banks.

Foreign Government

An account opened for or on behalf of a Foreign Government. This includes any departments, divisions, agencies, embassies, consulates, and diplomatic missions representing Foreign Governments.

Hedge Funds or Private Equity Funds

Are investment funds established to hold or manage investments and assets. They may be regulated or unregulated, listed or unlisted. Funds are managed by an investment manager. This does not include customer relationships where BMO is directing the transactions.

Money Services Business

Any business, registered as an MSB (Principal or Agent) with FINTRAC that is engaged in any of the following activities:
(i) foreign exchange dealing;
(ii) remitting or transferring funds by any means or through any person, entity or electronic funds transfer network;
(iii) issuing, selling or redeeming of traveler’s cheques, drafts, money orders or any other similar negotiable instruments;
(iv) any similar business as determined per local jurisdictional requirements.

Mortgage Brokerages

These are licensed business organizations that have a collective group of licensed brokers to carry out mortgage-related activities such as arranging mortgages for individuals and/or entities.

Non-Bank Financial Institutions

Non-Bank Financial Institutions (NBFI) are financial institutions that do not have a full banking license or are not supervised by a banking regulatory agency. They provide services related to financial and monetary transactions and may include Insurance Companies that provide products that feature a cash value or investment, Trust Companies, Mutual Funds and Pension Funds, Securities Broker Dealers, and Introducing Brokers in Commodities and Future Commission Merchants.

Non Registered Charitable/Not-For-Profit Organization

A private body that solicits or accepts donations however is not registered with the Canada Revenue Agency (CRA). This does not include community, school, sports, activity or nationally recognized service clubs, trade union/associations, or professional associations who fundraise, solicit or accept donations to support their own local activities.

Online Gambling Service Providers

Any business that are authorized/licensed to provide and operate online games of chance or mixed chance and skill (including, without limitation, on-line card games, roulette, slots or similar online casino-type gaming and online betting) for profit.

Pawnbroker

Any business that is engaged in lending money to an individual for an agreed period of time and holds some of the borrower’s personal goods as collateral to be sold to the public in the event of a default. This also includes any business that purchases articles from an individual and gives the same individual the option to buy back the article within a specified period of time. If the article is not bought back within the agreed period of time, the article will be sold to the public.

Precious Metals and Stones Industry

Precious Metals and Stones Cutters, Polishers or Refiners/Smelters include entities whose primary business involves cutting and polishing of rough stones or refining/smelting precious metals to prepare for wholesale, trading, manufacturing and retail stages.

Intermediate Dealers & Brokers of Precious Metals and Stones (PMS) Involved in Physical Movement of PMS (e.g. wholesale buyers & sellers) are involved in the transfer of precious metals (includes scrap precious metals) and stones between different parties and are often engaged in international trade. They include dealers that buy, trade (e.g. trading derivatives where there is physical delivery at the end of the trade) and sell physical precious metals and stones, wholesale buyers and sellers, as well as brokers who perform the physical sale, receives payment from the buyer and transfer the funds to the seller.

Retailers of Precious Metals and Stones and Fine jewellery include retailers whose primary business is to sell precious metals, precious stones or pearls (fine jewellery) to the end consumers through brick and mortar stores or online. This includes second-hand jewellery shops.

(Cutters/Polishers/Refiners/Smelters/Intermediate Dealers & Brokers/Retailers) Professional Service Providers

Professional Service Providers are Accounting Firms and Law Firms. This also includes Notary Firms established in British Columbia.

Ransomware Intermediary

Ransomware Intermediaries are cybercrime incident response entities who's primary business include helping ransomware victims to devise a remediation plan, act as intermediaries to negotiate with the cyber actors, facilitate ransomware payments and investigate the source of cyber security incidents

Real Estate Agencies/Brokerages

These are business organizations that have a collective group of licensed agents and/or brokers who act as an agent or mandatory between buyers and/or sellers for the purchase or sale of real estate property, land, houses, commercial buildings etc..

Real Estate Developers

Any entities whose primary business includes developing buildings and/or communities in order to sell them for a profit. This would not include entities such as contractors.

Shell Bank/Foreign Correspondent Banking relationships that is a Shell Bank or has Payable Through Activity

A shell bank is a financial term that describes a financial institution that does not have a physical presence in any country. Foreign Correspondent Banking Relationships are relationships established by a formal correspondent banking agreement between financial institutions located in different jurisdictions to facilitate, among other things, cross-border products and services such as cash management, international funds transfers and cheque clearing for their customers.

Telemarketing/Direct Marketing

Are businesses that primarily sell their own products or services through any non face-to-face method (e.g. telephone, email or postal mail) or are businesses that conduct Telemarketing/Direct Marketing activities on behalf of another company and are also responsible for processing the payments.

Businesses that are not included in this definition are those that

Start the contact with the customer using Telemarketing/Direct Marketing methods then fulfill the sales order through face to face contact
Only conduct marketing, promotional or advertising activity where there is no direct selling or payment processing

Third Party Payment Processor

Third Party Payment Processors originate transactions and provide payment processing services for consumers or businesses that are not direct customers of the TPPP’s financial institution. TPPPs can be any of the following:

Single purpose payment processors (e.g. processors of payroll, insurance, utilities, dividend/stock proceeds, mortgage/rent payments, health insurance, benefits payments, tuition/school related payments, club & association membership payments, travel & expense programs)
Merchant processors (e.g. processors for retailers, online businesses, telemarketers) which can facilitate the following transaction types:
Point of sale (POS) transactions – payments originating from debit/credit card, mobile phone or tablet (e.g. e-wallet). These transactions require face-to-face contact and occur through a physical or mobile device.
Online transactions – online payments originating from debit/credit card, pre-paid card or pre-authorized payments. These transactions do not require face-to-face contact and occur through the Internet.

Trust, Private Investment or Personal Holding company formed outside of Canada or USA

A Trust, Private Investment Company (PIC), or Personal Holding Company formed outside of Canada or USA is any legal arrangement or entity created for holding personal assets, formed in certain jurisdictions outside of Canada or USA

Unregulated Lenders or Businesses involved in Leasing and Financing

Are businesses offering asset based lending, leasing or financing services that are not associated to a FI. This includes the following:
Unregulated mortgage lenders, unregulated special purpose vehicles/legal entities set up for syndicated mortgages, unregulated mortgage investment entities (MIEs)
Unregulated entities whose primary business includes asset-based lending, leasing and financing (e.g. invoice financing/factoring, vehicle financing, pawn brokers)

US Marijuana Related Business

Used Vehicles Dealer

Used Vehicle Dealers are entities whose primary business are buying or selling used or second-hand vehicles (e.g. cars, trucks, boats, airplanes). This includes:

Buying or selling used or second-hand vehicles for the purpose of importing/exporting to/from foreign jurisdictions

Buying or selling used or second-hand “luxury” vehicles (any single vehicle sales of $150,000 USD/CAD and above)

This does not include businesses that sell used vehicles as a secondary business activity, for example, where used cars are sold in addition to the primary business of selling new vehicles on behalf of a major automobile manufacturer and their subsidiaries.

Virtual Currency

This includes the following customer segments; Network Facilitators, Virtual Currency Exchangers, Virtual Currency Administrators and Virtual Currency Custodians.

White Label ATM Operators

Businesses that operate, connect or provide the cash for more than one white label banking machine. White label banking machines are ABM's that are not associated with any major financial institution, such as those found in many bars/restaurants and convenience stores.
