Website user agreement
The following terms of use (the "Terms") apply to your use of all websites of BMO InvestorLine Inc. ("BMO IL") (individually referred to as a "Website" and collectively referred to as the "Websites") and access of online services of BMO IL ("Online Services"). For clarity, the term "Websites" includes any Websites accessed through the Application (as defined below) and the term "Online Services" includes Mobile Services (as defined below). By using Websites, you accept and agree to be bound by and comply with the Terms and any terms, conditions, legal notices and disclaimers in the footers, content or other pages of the Websites and behind links, buttons or icons on the Websites (the "Additional Terms") in the same way as if you have signed a printed version and you will be bound by them and they will continue to apply every time you use the Websites. These terms are additional to the terms of the client account agreements governing your BMO IL self-directed account(s).
The Terms and Additional Terms also apply to your use of any downloadable application or other technology to access any features, functionality, content and/or information that is made available or provided on the Websites (individually referred to as an "Application" and collectively referred to as the "Applications").
In the event of any conflict between the Terms and the Additional Terms, the Additional Terms will govern.
All products and services of BMO IL that are described, made available or provided on the Websites may be changed or withdrawn at any time without notice and are subject to the terms and conditions of the applicable agreements governing their use in force at the time of the provision of the product or service, in addition to the Terms and Additional Terms. In the event that the Terms or Additional Terms are inconsistent with the terms of any agreement that you or your organization may have with BMO IL, the terms of that agreement will govern.
The information, material and content provided in the pages of the Websites, including pricing information, (the "Information") is believed to be reliable when posted, but there is no guarantee that it is accurate, complete or current at all times. You acknowledge that it is not possible for us to provide the Online Services free from defects. The Online Services, the Websites and the Application utilize complex computer and telecommunications networks and that, as such, continued, uninterrupted and error free access to the Online Services, the Websites and/or the Application cannot be guaranteed.. The Online Services, the Websites and the Application may be delayed, unavailable, not delivered and/or inaccurate from time to time due to a variety of factors, including technical reasons, for planned or unplanned maintenance or downtime, for editorial amendments or for any other reason.
No liability

Information provided by you
You agree that any information or materials that you provide to any of BMO IL through any of its Websites shall become the sole property of BMO IL, and may be used freely by BMO IL. By providing such information and materials, you declare and warrant that you have all necessary rights to submit such information and materials and that the information and materials do not infringe the rights of third parties.
Electronic Communication via the Internet
Any unprotected electronic communication over the Internet is, as with communication via other mediums (e.g. cellular phones, post office mail), not secure or confidential, subject to possible interception or loss, and possible alteration. You should not send any confidential, proprietary or sensitive information about you or others via these mediums. BMO IL is not responsible for and will not be liable to you or anyone else for any damages in connection with an email, text message, comment, post or any other electronic message sent by you to BMO IL, or an email, text message, comment post or any other electronic message sent by BMO IL to you.

BMO IL requires that clients use at least 128 bit encryption (and up to 256-bit encryption) when conducting financial transactions over the Internet. We also recommend the use of up to 256-bit encryption for all non-financial transactions over the Internet. If you are a BMO IL client and wish to access your account through the Websites, ensure that you have a browser up to 256-bit encryption. If your browser doesn't operate at this level of encryption, you will likely see an "Insufficient Encryption" message when you try to sign into your account.

Software Back-up

Protecting Your Confidentiality
In any business, privacy of personal information is desirable; in financial services, it is essential. At BMO IL we value your privacy on the Internet and think you do too, and we feel you should know:

- how you can opt-out, update or delete your Personal Page information from our database.
How we protect your information
When you sign into your BMO IL account your financial transactions and your Retirement Planner session are protected by 128-bit encryption. When you create a Personal Page or sign into your Personal Page your session is protected by 40-bit or 128-bit encryption, depending on the type of browser you are using.
Encryption is a means of scrambling information for transmission, in this case, between your PC and BMO Bank of Montreal's computing systems. Information that is encrypted at one end is decrypted (decoded) upon receipt at the other end.
128-bit encryption is the strongest, most secure form of encryption that is generally available in Internet browsers on the market in North America today. BMO IL and BMO Bank of Montreal require that our clients use 128-bit encryption when conducting financial transactions over the Internet. We also recommend the use of 128-bit encryption for all non-financial transactions over the Internet, e.g. the use of the Personal Page section on the Websites.
How we use the information that you provide to us
Information you provide during the registration process for the Personal Page of the Website is collected and stored by BMO IL. The information you provide may be used:
- To give us information that may be helpful in determining appropriate new features, content or services
- To contact you, from time-to-time, to offer products and services from BMOIL that we feel you may be of interest to you.
How you can opt-out, update or delete your information from our database
If at the time of registration for the Personal Page, you had indicated that you would like us to send you updates on site developments or on new products and services, BMO IL may send you these updates by email or mail. If you decide at any time that you do not want to receive these updates or if you want us to delete your information from the Personal Page, simply call us at 1-888-776-6886 during our business hours from 8:00 a.m. - 8:00 p.m. ET, Monday to Friday.

Use of Cookies

The Applications

You must be a BMO IL client with a valid, active and funded BMO IL account in good standing. You will not have access to all of the same services, features, functionality, content or information through Applications as you may through Online Services (including your online message centre, notices, legal and privacy terms, links, bills, statements and complete transaction and account information) and you must access Online Services through a technology other than the Applications on a regular basis to access the services, features, functionality, content and information of such Online Service.
You may only use the Applications on mobile devices that are authorized by BMO IL as being eligible to receive the Mobile Services.
You will only use the Mobile Service and the Applications solely and exclusively for your own personal, private, non-commercial use and on registered mobile devices belonging to you.
You will at all times comply with (and your use of the Mobile Service and the Applications will at all times be in compliance with) all applicable laws, rules and regulations, including, without limitation, applicable export and import control laws and regulations, and you will not knowingly allow any other party to use the Mobile Service or the Applications for or in connection with any illegal purpose or activity. The Applications are not intended for distribution or use by any person in any jurisdiction or country where such use and/or distribution would be contrary to local laws, rules and/or regulations. It is your responsibility to comply with all local laws, rules and/or regulations.
You may only use the Applications for the purpose of accessing the Mobile Services and for no other purpose whatsoever.

You will comply at all times with all technical and security requirements which we establish regarding the Mobile Services.
In the event that you fail to comply with the Terms or Additional Terms or your account(s) at BMO IL are closed, all rights granted to you in relation to the Applications and the Mobile Services shall immediately come to an end and you will immediately destroy all copies of the Applications.
You will not:
- alter, modify, adapt or translate the whole or any part of the Applications, or any other computer software made accessible to you or otherwise used by you to access and use the Mobile Services, or perform maintenance on the Application, nor will you duplicate, compile, disseminate, reverse engineer, disassemble, decompile, disable any features, or otherwise derive the source code for the Applications, or any component of the Applications, in whole or in part;
- merge the Applications or any component thereof into any other programs or create derivative works based on any component of the Applications;

- remove or tamper with any proprietary notices or labels, including copyright notices or data source attributions, attached to or contained within the Applications or the Mobile Services;
- use the Applications or the Mobile Services in any way that may lead to the encouragement, procurement or carrying out of any unlawful or criminal activity or which may cause any harm or injury to any person; or
- cause damage to any of the websites, servers, systems or equipment used in the provision of the Mobile Service by BMOIL or any other third party, and you may not access or attempt to access any user data or to penetrate any of the security measures relating to the Mobile Services; and will in all cases indemnify and hold harmless BMO IL and its affiliates from any and all Claims in respect thereof.

The Applications may not be available for use in locations outside of Canada and the United States. You are responsible for any fees imposed by a service provider that you might incur by accessing the Applications.
